Mahmoud Khalil Appeals to Supreme Court Over ICE Detention

Attorneys for former Columbia University organizer Mahmoud Khalil petitioned the U.S. Supreme Court on Monday to review an appellate ruling that blocked his challenge against federal immigration authorities, who detained him in March 2025 citing his political activism as a threat to U.S. foreign policy interests.

The case centers on the 3rd Circuit Court of Appeals’ decision to overturn a ruling by U.S. District Judge Michael Farbiarz, who had initially ordered Khalil’s release. Farbiarz argued that the permanent resident posed no danger and was not a flight risk. The appellate court subsequently dismissed the case, ruling that federal courts lack jurisdiction over these specific immigration matters. Khalil’s legal team, including the Center for Constitutional Rights, contends that this decision effectively strips individuals of habeas corpus protections against arbitrary, retaliatory detention. They argue the government is weaponizing the immigration system to punish protected First Amendment speech, creating a chilling effect on both citizens and noncitizens alike. The Supreme Court is now being asked to determine whether federal courts retain the authority to intervene when constitutional rights are jeopardized by administrative detention.
