Berry argues that Olivier Martinez is systematically misrepresenting their September 26 disagreement to gain a legal advantage. According to court filings, she maintains that the interaction was merely playful roughhousing gone wrong, refuting accusations that she choked their son. She further contends that Martinez is cherry-picking communications and distorting statements from her partner, Van Hunt, to manufacture an appearance of guilt where none exists.
The legal conflict has intensified with Martinez requesting that the teenager testify directly before the judge to provide his account of the incident. This push for Maceo’s testimony follows a Los Angeles judge’s October 1 decision to impose a temporary restraining order, which restricts Berry’s visitation time and requires her to maintain a 100-yard distance from her ex-husband. While Berry seeks to reinstate their previous 50/50 custody arrangement, she claims that the current restrictions have negatively impacted their son’s behavior at school.
Complicating matters, the court is weighing a declaration from Berry’s 18-year-old daughter, Nahla Aubry, who has staunchly defended her mother’s parenting. Martinez has moved to dismiss Nahla’s input, labeling it biased, while the court prepares for a critical hearing on October 16. This session will determine whether to maintain the current temporary orders or return to the joint custody agreement finalized by the couple last year.
